Online payments are not yet enabled. Products may be added to the cart and checkout details reviewed, but no order is submitted or payment collected until payment services become available.

You may browse and purchase products as a guest. If you choose to create an account, you agree to provide accurate and complete information and to update your information to keep it accurate. You are responsible for safeguarding your password.

5. Products and Pricing

We strive to display products and prices accurately. However, we do not warrant that product descriptions, pricing, or availability are accurate, complete, or current. All products are subject to availability. We reserve the right to correct errors and modify prices without notice.

6. Orders

All orders placed through this Site are subject to acceptance and availability. We reserve the right to refuse or cancel any order at any time. Orders cannot currently be submitted while online payments are unavailable.

We ship to addresses within the United States only. Shipping rates and delivery times are described in our Shipping Policy. We are not liable for shipping delays caused by carriers.

17. Dispute Resolution — Binding Arbitration

Any dispute or claim arising out of or relating to these Terms or your use of the Site shall be resolved by binding arbitration administered by JAMS (Judicial Arbitration and Mediation Services) in accordance with its Streamlined Arbitration Rules. The arbitration shall be conducted in Utah. The arbitrator's award shall be final and binding, and judgment may be entered in any court of competent jurisdiction.

18. Class Action Waiver

You and JOHN VARELIX LLC agree that each party may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class, consolidated, or representative action. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

19. Governing Law and FAA

These Terms shall be governed by the laws of the State of Utah, United States of America, without regard to conflict of law principles. The Federal Arbitration Act (9 U.S.C. §§ 1-16) governs the interpretation and enforcement of the arbitration provision. If arbitration is deemed unenforceable for any claim, that claim shall be resolved in the state or federal courts located in Utah.

20. Force Majeure

We shall not be liable for any delay or failure to perform our obligations due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, labor disputes, government actions, pandemics, supply chain disruptions, or failures of internet or telecommunications infrastructure.

These Terms, together with our Privacy Policy, Returns Policy, Refund Policy, Shipping Policy, Warranty Policy, and Cookie Policy, constitute the entire agreement between you and JOHN VARELIX LLC regarding your use of the Site and supersede all prior agreements.

29. Survival

Provisions that by their nature should survive termination of these Terms shall survive, including but not limited to intellectual property, disclaimer of warranties, limitation of liability, indemnification, dispute resolution, and governing law provisions.
